1. Acceptance of these Terms

These Terms of Use (the “Terms”) form a binding agreement between you and NutriTrack (“NutriTrack”, “we”, “us” or “our”) and govern your access to and use of the NutriTrack mobile application, the website at nutritrackaipro.com, and all related features, content and services (together, the “Service”). By creating an account, taking the quiz, purchasing a subscription, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, each incorporated here by reference. If you do not agree, please do not use the Service.

2. Who we are

The Company is the merchant of record for purchases made directly through our website. You can reach us at any time at support@nutritrackaipro.com.

3. Description of the service

NutriTrack is an AI-powered nutrition coach. The Service helps you estimate calories and macronutrients (protein, fat and carbohydrates) — including from photos of your food that you submit for analysis — set a personalized nutrition target based on your goals, log meals, and follow an adaptive plan with coaching prompts. The app is available on iOS via the Apple App Store, with an Android version coming soon. Certain features require a paid subscription. We may add, modify or remove features at any time as described in Section 14.

Nutritional values, calorie estimates and photo-based analyses are approximate and provided for general informational and wellness purposes only. They may not be exact and should not be relied upon for clinical or medical decisions (see Section 11).

4. Eligibility & age

You must be at least 16 years old (or the age of digital consent in your country, if higher) to create an account and use the Service, and you must have the legal capacity to enter into a binding contract. The Service is not directed to children. By using the Service you represent that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

5. Your account

To use most features you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@nutritrackaipro.com if you suspect any unauthorized use. You are responsible for the accuracy of the profile and quiz data you provide; inaccurate data may reduce the quality of your personalized plan.

6. Subscriptions, pricing & billing

NutriTrack offers auto-renewing paid subscriptions. Current plans and introductory pricing are:

• Monthly — $9.99 for the first month, then $19.99 per month.
• 3 months — $24.99 for the first 3 months, then $44.99 per 3 months.
• 12 months — $39.99 for the first year, then $79.99 per year.

All prices are stated in US dollars (USD) and are exclusive of any sales tax, VAT or other local taxes that may apply, which will be added where required. The introductory price applies only to your first billing period on a given plan; thereafter the plan renews at the standard price shown above. We may change our prices from time to time; any price change will apply only to future billing periods and we will give you notice as required by applicable law before it takes effect.

By purchasing a subscription, you authorize us (or our third-party payment processor, or the applicable app store) to charge your payment method the applicable price, plus taxes, for the initial period and for each renewal period until you cancel. When you buy directly on our website, payment is handled by our third-party payment processor; when you buy through the Apple App Store, Apple processes the payment and their terms also apply. You are responsible for providing valid and current payment information.

7. Auto-renewal & cancellation

All subscriptions automatically renew at the end of each billing period at the standard (non-introductory) price for that plan, unless you cancel before the renewal date. This keeps your access uninterrupted.

You can cancel at any time before your next billing date:

• In the app — with one tap in your subscription settings; or
• By email — write to support@nutritrackaipro.com and we will help you cancel.
• App Store purchases — if you subscribed through the Apple App Store, manage or cancel the subscription in your Apple account settings; cancellation there is subject to Apple’s rules.

Cancellation stops all future charges. Your subscription — and access to paid features — continues until the end of the period you have already paid for, after which it will not renew. Canceling does not, by itself, generate a refund for the current period; refunds are governed by Section 8 and the Refund Policy.

8. Refunds

We offer a 30-day money-back guarantee on your first purchase, subject to the terms set out in our Refund Policy. In short: if you follow your plan in good faith and are not satisfied within 30 days of your first payment, you may request a full refund at support@nutritrackaipro.com. Renewal charges are generally non-refundable, but you can cancel at any time to prevent future charges, and you may ask us to review an unexpected renewal charge. Purchases billed through the Apple App Store are subject to Apple’s refund process. Please see the full Refund Policy for details.

9. Acceptable use

You agree to use the Service only for lawful, personal, non-commercial purposes and in compliance with these Terms. You will not:

• copy, resell, sublicense or commercially exploit any part of the Service without our written permission;
• reverse-engineer, decompile, scrape, or attempt to extract source code or datasets from the Service, except to the extent permitted by law;
• upload content that is unlawful, infringing, harmful, or that you do not have the right to submit;
• interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or other users’ accounts;
• use the Service to build or train a competing product, or misrepresent your identity.

We may suspend or terminate access that violates this Section.

10. Intellectual property

The Service, including its software, design, text, graphics, logos, the “NutriTrack” name, and all underlying content and databases, is owned by the Company or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal use in accordance with these Terms. All rights not expressly granted are reserved. You retain ownership of the content you submit (such as food photos and logs), and you grant us a worldwide, royalty-free license to host, process and use that content solely to operate, provide and improve the Service, as further described in our Privacy Policy.

11. Health disclaimer — not medical advice

NutriTrack provides general wellness and informational content only and does not provide medical advice, diagnosis or treatment. Calorie, macro and nutrition estimates, targets, and coaching prompts are for general informational purposes and are not a substitute for professional medical, nutritional or psychological advice. You should consult a qualified physician or healthcare professional before starting any diet, weight-management, exercise or nutrition program, especially if you are pregnant or nursing, have a medical condition (including diabetes, an eating disorder, or a history of disordered eating), or take medication. Never disregard professional medical advice or delay seeking it because of something you read or saw in the Service. Individual results vary and are not guaranteed; the Service does not promise any specific weight, health or fitness outcome. If you experience a medical emergency, call your local emergency number immediately.

12. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that estimates and analyses will be accurate or complete. Your use of the Service is at your own risk.

13. Limitation of liability

To the maximum extent permitted by law, the Company and its owner, suppliers and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill, or health outcomes, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages. To the extent liability cannot be excluded, our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you; in that case our liability is limited to the smallest extent permitted by law.

14. Changes to the service & these Terms

We may modify, suspend or discontinue all or part of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email. Changes take effect when posted (or on a later stated date). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Service and may cancel your subscription.

15. Termination

You may stop using the Service and cancel your subscription at any time as described in Section 7. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply. You may request deletion of your data as described in our Privacy Policy.

16. Governing law

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the jurisdiction in which the Company is established, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence provide you with additional rights that cannot be waived. We will always try to resolve disputes with you informally first — please contact us before taking any formal action.
