This Privacy Policy explains how NutriTrack (“NutriTrack”, “we”, “us” or “our”) collects, uses, shares and protects your personal data when you use our AI nutrition coach mobile app, our website at nutritrackaipro.com, and related services (together, the “Service”). It also describes your privacy rights and how to exercise them. Please read it together with our Terms of Use. By using the Service you acknowledge the practices described here.

2. Who is responsible for your data

3. Data we collect

We collect the following categories of personal data, most of which you provide directly:

• Account data — your email address and authentication details used to create and secure your account.
• Quiz & profile data — answers you give in our onboarding quiz and profile, such as age, sex, height, weight, goal, activity level and dietary preferences, which we use to calculate your personalized nutrition plan.
• App usage & food logs — the meals and foods you log, your calorie/macro entries, progress data, and photos of food that you submit for analysis by our AI.
• Payment-related data — records of your subscriptions, plan, transaction identifiers and billing status. Full card numbers are handled by our payment processor and are not stored by us (see Section 7).
• Device & technical data — device type, operating system, app version, language, IP address, identifiers, and diagnostic/crash data.
• Cookies & analytics data — information collected through cookies and similar technologies on our website (see Section 13).

Some profile and food-log information may relate to your health or wellness. Where such data is treated as sensitive under applicable law, we process it only to provide the Service you request and, where required, with your consent.

4. How we use your data

We use your personal data to:

• provide, operate and personalize the Service, including computing your nutrition target and adaptive plan and analyzing food photos you submit;
• create and manage your account and provide customer support;
• process payments, subscriptions, renewals and refunds via third-party payment processors;
• send you service communications (such as account, billing and security notices) and, with your consent, marketing emails about features and offers;
• maintain, secure, troubleshoot and improve the Service, including product analytics and developing new features;
• detect, prevent and address fraud, abuse and security incidents; and
• comply with our legal obligations and enforce our Terms of Use.

5. Legal bases for processing

Where data-protection law (such as the GDPR) applies, we rely on the following legal bases: performance of our contract with you (to provide the Service you sign up for); your consent (for marketing emails and, where applicable, processing of health-related data — you can withdraw consent at any time); our legitimate interests (to secure, analyze and improve the Service) balanced against your rights; and compliance with legal obligations (such as tax and accounting rules).

6. How we share data

We do not sell your personal data. We share it only as needed to run the Service, with trusted third-party sub-processors that act on our instructions under contract, including:

• Payment processors — to process card and subscription payments;
• Cloud hosting & infrastructure — to host the app, store data and run our AI analysis;
• Email & messaging providers — to send service and marketing communications;
• Analytics providers — to understand and improve how the Service is used.

We may also disclose data when required by law, to comply with legal process, to protect our rights, users or the public, or in connection with a business transfer (such as a merger or acquisition), in which case we will ensure your data remains protected under this policy or an equivalent one.

7. Payments

When you purchase a subscription on our website, payment is processed by our third-party payment processor, which collects and handles your card details directly under its own security standards; we receive only limited transaction information (such as the result, amount and a reference), not your full card number. When you subscribe through the Apple App Store, Apple processes your payment under Apple’s privacy terms. See our Refund Policy for billing and refund details.

8. Data retention

We keep your personal data for as long as your account is active and as needed to provide the Service. After you close your account or request deletion, we delete or anonymize your data within a reasonable period, except where we must retain certain information to comply with legal, tax, accounting or dispute-resolution obligations, or to enforce our agreements. Backup copies are deleted on a rolling schedule.

9. Your rights & choices

Depending on where you live, you may have the right to:

• access a copy of the personal data we hold about you;
• correct inaccurate or incomplete data;
• delete your data (“right to be forgotten”);
• opt out of marketing at any time — click “unsubscribe” in any marketing email or contact us;
• data portability — receive your data in a portable, machine-readable format;
• object to or restrict certain processing, and withdraw consent where we rely on it.

To exercise any of these rights, email support@nutritrackaipro.com. We will respond within the time required by applicable law and may need to verify your identity first. You also have the right to lodge a complaint with your local data-protection authority.

10. Security

We take the protection of your data seriously and use appropriate technical and organizational measures — including encryption in transit, access controls, and use of reputable hosting and payment providers — to protect personal data against unauthorized access, loss, misuse or alteration. No method of transmission or storage is completely secure, so we cannot guarantee absolute security; you are responsible for keeping your login credentials confidential.

11. International data transfers

We and our sub-processors may process and store your personal data in countries other than the one where you live, including outside your region, whose data-protection laws may differ from yours. Where we transfer personal data internationally, we take steps to ensure it receives an adequate level of protection, such as relying on appropriate safeguards (for example, standard contractual clauses) where required by law.

12. Children’s privacy

The Service is intended for adults and is not directed to children. You must be at least 16 years old (or the higher age of digital consent in your country) to use it. We do not knowingly collect personal data from children under 13. If you believe a child has provided us personal data, please contact us and we will delete it.

13. Cookies & analytics

Our website uses cookies and similar technologies to keep the site working, remember your preferences, measure traffic, and understand how visitors use our pages so we can improve them. Some cookies are strictly necessary; others are used for analytics and, where applicable, marketing measurement.
